Read this agreement carefully. You may use the Jobsonphone services (as defined herein below) only on the condition that you agree to comply with all of the terms in this agreement.

By using or registering for the Jobsonphone services, you are agreeing electronically to the following terms and conditions (the "terms of service"). If you do not agree to these terms, do not use the Jobsonphone services.

1. Acceptance of terms of use for this website & the Mobile Portal
1. The online service provided by Jobsonphone is to enable executives in   finding and connecting with other professionals more effectively. Whether looking to enhance/share knowledge, brand yourself on the web, getting answers to your professional questions, or being part of niche communities.
2. Nothing in this terms of service shall be deemed to confer any third-party rights or benefits.
3. We reserve the right to modify this agreement at any time, and without prior notice, by posting amended terms on this website. Your continued use of the Jobsonphone service indicates your acceptance of the amended terms of service. 
4. The information provided on this web site includes, but is not limited to, the services provided by Jobsonphone and do not render any advice, certifications, guarantees or warranties relating to the Jobsonphone services.
2. Eligible users

The Jobsonphone service is not available to minors under the age of 18 or to any users suspended or removed from the system by Jobsonphone for any reason. Users may not have more than one active account. Additionally, users are prohibited from selling, trading, or otherwise transferring their Jobsonphone account to another party. If you do not qualify, you may not use the Jobsonphone service.

3. Purpose

Your use of the Jobsonphone service is governed by this terms of service. Jobsonphone may refuse service without prior notice to any user for any or no reason. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login and password information to another person, your account privileges may be suspended temporarily or terminated. You agree to immediately notify Jobsonphone of any unauthorized use of your password or account or any other breach of security. Jobsonphone cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Access to service and obligations

You understand and agree not to use Jobsonphone to:

1. Post content or initiate communications which are unlawful, libelous, abusive, obscene, discriminatory, or otherwise objectionable.
2. Use the service for any illegal purpose, including but not limited to conspiring   to violate laws.
3. Falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations with a person or entity, past or present.
4. Upload, post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as  part of employment relationships or under nondisclosure agreements).
5. Directly or indirectly breach the terms of an employment contract or any other contract executed by you.
6. Upload, post, email, transmit or otherwise make available any content or initiate    communication    that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.
7. Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation. This prohibition includes but is not limited to

(a) Using Jobsonphone invitations to send messages to people who dont know you or who are unlikely to recognize you as a known contact;

(b) Using Jobsonphone to connect to people who don.t know you and then    sending unsolicited promotional messages to those direct connections without their permission; and

(c) Sending messages to distribution lists, newsgroup aliases, or group aliases.

8. Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the  functionality of any computer software or hardware or telecommunications equipment.
9. Stalk or harass anyone.
10. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any       communication transmitted through the service.
11. Post content in fields that aren.t intended for that content. Example: putting an address    in a name or title field
12. Interfere with or disrupt the service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the service.
13. use of manual or automated software, devices, or other processes to crawl or spider any web pages contained in the Jobsonphone website is strictly prohibited. You agree not to monitor or copy, or allow others to monitor or copy, our web pages or the content included herein. You also agree not to frame or otherwise simulate the appearance or function of this website. Furthermore, you agree not to take any action that interferes with the proper working of or places an unreasonable load on our infrastructure, including but not limited to unsolicited communications, attempts to gain unauthorized access, or transmission or activation of computer viruses.

Recognizing the global nature of the internet, you agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from India or the country in which you reside.

5. Other services 

5.1 articles posted on the web site are form of knowledge and are primarily for the users of the website to share and enhance there knowledge regarding a specified field of operation or of interest to them. Jobsonphone does not allow any user to post article which directly or indirectly is against any cast, religion, creed or sex or which involves racial discrimination, articles which directly or indirectly are against the purpose of Jobsonphone will be removed and action against users who are found responsible of posting them will be as per the sole discretion of Jobsonphone. Jobsonphone software will automatically send you relevant articles to you as per your preferences. You can change your set preferences accordingly to receive articles for your benefit.

5.2 you will find a host of communities which are currently operating on the website and many more will be formed during the course of your usage. You can join, form and refer communities according to your area of interest; you can also invite other users and non users to join communities which you think will be of interest to them. Communities are basically found to bring closer likeminded professional people to interact with each other following a common professional interest. Communities formed to promote any racial discrimination, violate any cast, nationality or laws are not entertained by the Jobsonphone.          

  in case if you create, refer any community and invite any user/nonuser, you will be entirely held responsible for the actions you take. A user has the right to accept or to reject any such invitation or referral to a community.

5.3 you can post job openings in your company, free of cost and can refer the same to your friends and community members. You can also refer a job posted by another user to your friends and community members. In case of referring a sponsored job posted by a company the referrer will be entitled to a part of the referral amount entirely at the discretion of Jobsonphone.

5.4 in the course of providing you services, Jobsonphone may need to communicate with you via email (see our privacy policy to learn more about communications), SMS or a call. You agree to receive these communications which are specific to your account and necessary for the normal functioning of the Jobsonphone service, including a series of welcome emails or sms or call which help inform new users about various features of the Jobsonphone service. You also agree to have your name and/or email address & mobile number listed in the header of certain communications which you initiate through the Jobsonphone service. 

6. Security 

6.1 in the course of using the Jobsonphone service, users may provide information about themselves which may be visible to certain other users (see our privacy policy to learn more about information collected on this website). You understand that by posting materials on the Jobsonphone website or otherwise providing materials to Jobsonphone, you are granting to Jobsonphone consultancy a royalty-free, perpetual, irrevocable license to use this information in the course of offering the Jobsonphone service. Furthermore, you understand that Jobsonphone retains the right to reformat, excerpt, or translate any materials submitted by you. You understand that all information publicly posted or privately transmitted through the Jobsonphone service is the sole responsibility of the person from which such content originated and that Jobsonphone will not be liable for any errors or omissions in any content. You understand that Jobsonphone cannot guarantee the identity of any other users with whom you may interact in the course of using the Jobsonphone service. Additionally, we cannot guarantee the authenticity of any data which users may provide about themselves or relationships they may describe.

6.2 while we have the right to monitor activity and content associated with the Jobsonphone service, we are not obligated to do so. And since we do not, and may not have the ability to, control or actively monitor content we dont guarantee its accuracy, integrity or quality. Because community standards vary and individuals sometimes choose not to comply with our policies and practices, in the process of using our website, you may be exposed to content that you find offensive or objectionable.

6.3 you can contact Jobsonphone at customerservice@jobsonphone.com to let us know of content that you find objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts. However, because situations and interpretations vary, we also reserve the right not to take any action. Under no circumstances will we be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any content on the website.

7. Charges

Other Mobile Users sms JOBS to 5855815. Operator charges may apply for sending premium sms.

Jobsonphone reserves the right to charge for the Jobsonphone service or any portion thereof, modify the pricing of, add to, or discontinue the Jobsonphone service or any portion thereof without prior notice. 

8. Indemnification

 

         By accepting this terms of service, you agree to indemnify and otherwise hold harmless, Jobsonphone, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from

1. Your use of the Jobsonphone service;

8.2 unauthorized access to or alteration of your communications with or through the Jobsonphone service, or

8.3       any other matter relating to the Jobsonphone service.            

Any business transactions which may arise between users from their use of Jobsonphone are the sole   responsibility of the users involved. Without limitation of the terms and conditions set forth in our privacy policy, you understand and agree that Jobsonphone may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce this terms of service, or protect the rights, property, or safety of Jobsonphone, its users, and the public.       

9. Disclaimer

You understand and agree that the Jobsonphone service is provided on an as is and as available basis and that Jobsonphone does not assume any responsibility for prompt or proper delivery, or retention of any user information or communications between users. Jobsonphone assumes no responsibility for the accuracy or existence of any communications between users. Jobsonphone expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Jobsonphone makes no warranty that:-

1. The Jobsonphone service will meet your requirements,
2. The Jobsonphone service will be uninterrupted, timely, secure, or   error-free,
3. The results that may be obtained from use of the Jobsonphone service will be accurate or reliable,
4. the quality of any services, information, or other material obtained by you through the Jobsonphone service will meet your expectations, and
5. Any errors in the software will be corrected.

Any material obtained through the use of the Jobsonphone service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the usage of any such material.

No advice or information, whether oral or written, obtained by you from Jobsonphone or through or from the Jobsonphone service shall create any warranty not expressly stated in this user agreement.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

10. Limitation of liability

Neither Jobsonphone nor its affiliates, employees, agents or consultants shall in any event be liable for any indirect, incidental or consequential damages such as, but not limited to, loss of business information, loss of goodwill, business interruption or loss of anticipated profits or benefits resulting from use of the site or services or any part or whole of the content or arising out of any breach of warranty even if Jobsonphone or its affiliates, employees, agents or consultants have been advised of the possibility of such damages.  

Such limitation of liability shall apply whether the damages arise from use or misuse of or reliance on Jobsonphone information, from inability to use Jobsonphone information, or from the interruption, suspension, or termination of access to the content or site (including such damages incurred by third parties). This limitation shall also apply, without limitation, to the costs of procurement of substitute content, loss of goodwill, loss of profits, or loss of data. Such limitation shall further apply with respect to the performance or non-performance of Jobsonphone or any information that appears on, or is linked or related in any way to, the site provided there under. Such limitation shall apply not withstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.

In no event shall the liability of Jobsonphone or its affiliates, to you for any and all claims relating to the use of the services exceed the total amount of service fees that you paid during a period of 6 (six) months for the specific service at issue, immediately preceding the day on which the claim or the liability arose.

11. Acknowledgment

Our disclaimer and limited liability as set out in these terms of service are fundamental elements of the basis of the bargain services to be provided to you by us. You agree that we would not otherwise be able to offer services on its present basis without such limitations. This clause shall survive any termination of these terms of service.

12. Proprietary and intellectual property rights

Jobsonphone is the owner and/or authorized user of any trademark, registered trademark and/or service mark appearing on the website, and is the copyright owner or licensee of the content and/or information on the website including but not limited to any text, images, illustrations, audio clips, video clips and screens appearing on the website.  

All rights on the website are reserved and you may not download and/or save a copy of the website or any part thereof including any of the screens or part thereof and/or reproduce, store it in a retrieval system or transmit it in any form or by any means electronic, electrostatic, magnetic tape, mechanical printing, photocopying, recording or otherwise including the right of translation in any language without the express permission of the company (except as otherwise provided on the website or in the terms and conditions for any purpose) or use it in any manner that is likely to cause confusion or deception among persons or in any manner disparages or discredits the company or the merchant. However, you may print a copy of the information on this site for your personal use or records. This website is for your personal use. If you make other use of this website, except as otherwise provided above, you may violate copyright and other laws of India and other countries, and may be subject to penalties. The company and the merchant do not grant any license or other authorization for usage of its trademarks, registered trademarks, service marks, or other copyrightable material or other intellectual property by placing them on the website. 

13. Links to other websites 

This website may contain hyperlinks to websites operated by parties other than Jobsonphone. The inclusion of hyperlinks to such websites does not imply the Jobsonphone.s certification or endorsement of such websites nor any of its association with other operators. Jobsonphone or its affiliates or associates or its employees do not provide any judgment or warranty in respect of the authenticity or correctness of the content of such other services or websites to which links are provided. A link to another service or website is not an endorsement of any product or service on such websites. You shall be solely responsible for any or all the consequences that arise out of your use of such hyperlinks to websites.

14. Termination       

 
You agree that Jobsonphone may, with or without cause, immediately terminate your Jobsonphone account and access to the Jobsonphone service without prior notice. Without limiting the foregoing, the following will lead to a termination by Jobsonphone of a user.s use of the Jobsonphone service

             14.1 breaches or violations of these terms of service or other incorporated agreements or guidelines,      

        14.2  requests by law enforcement or other government agencies,

14.3  a request by you (self-initiated account deletions),

14.4 unexpected technical issues or problems, and       

      14.5  extended periods of inactivity.

Termination of your Jobsonphone account includes removal of access to all offerings within the Jobsonphone service and may also bar you from further use of the Jobsonphone service. Furthermore, you agree that all terminations shall be made in Jobsonphone.s sole discretion and that Jobsonphone shall not be liable to you nor any third-party for any termination of your account or access to the Jobsonphone service.

15. Governing law

All legal proceedings shall be subject to the jurisdiction of the courts in Chandigarh, India and shall be governed by and construed in accordance with the laws of India and you agree to resolve the disputes under the arbitration and conciliation act 1996. The venue for such arbitration shall be at Chandigarh, India.

15. Miscellaneous
1. Entire agreement: the terms of service constitutes the entire agreement between you and Jobsonphone and governs your use of the Jobsonphone service, superseding any prior agreements between you and Jobsonphone.
2. Severability: any provision of this agreement which is invalid, prohibited or unenforceable in any jurisdiction shall: (i) be ineffective in that jurisdiction to the extent of the invalidity, prohibition or unenforceability; (ii) not invalidate the remaining provisions of this agreement; and (iii) not affect the validity of that provision in any other jurisdiction.
3. Relationship: this agreement or your use of this website does not constitute any joint venture, partnership, employment or agency relationship between you and Jobsonphone.
4. Assignment: Jobsonphone may assign this agreement at any time without a notice to you. You may not assign this agreement to any one else.
5. General information: Jobsonphone, and other Jobsonphone logos and names are trademarks of Jobsonphone. You agree not to display or use these trademarks in any manner without Jobsonphone 's prior, written permission. The section titles of this terms of service are displayed for convenience only and have no legal effect.
